
Wajax Pension Surplus Challenge Update - November 1, 2001
It has been sometime since your committee has reported to the
contributors and thus the following update.
In our earlier updates (see documents) we stated that our
support had been outstanding and that we had engaged Harbottle and Company, a
very respected law firm who won a very similar case to ours for the Bank of B.C,
employees.
For the last few months, they have been documenting the case and attempting to
fill the gaps where information is missing. (Remember they are going over
documentation back to 1967 and there are hundreds of documents).
In addition, during the time that our case has been worked on there have been a
few other cases in Canada where the Employees have won in court. Thus the
seemingly long time we've been working on this has probably aided our cause.
To complete our case we need the following assistance from you the members.
1. In a couple of places we find the documentation of the
Pension Plan that we all belong to (called the 1967 Plan) makes reference to the
former plan. This was the plan that was in effect from 1958 to 1966. These
references could affect our case positively or negatively thus should be checked
out. So if any of you have any information, Pension Plan booklets or anything
else on the old plan please contact either Gerry Cunningham or Gordon Donaldson.
2. We would appreciate anyone who has the benefit statements, pension plan
booklets, or any correspondence regarding upgrades, surpluses, etc. from 1967 to
date to also contact us to see if this material is helpful to our case.
3. Many members have said that over the years when they
questioned their superiors about the Pension (especially the low % interest
applied to their contribution each year) that they were told that upgrades would
make up for this. We will need a few people to give affidavits to this so
please try to remember, when,, where and in what context such conversations took
place.
